I got hit after I merged in the service road of betlway?

cars were alternating turn but this one decided to not do that after I merged an SUV tried to move infront of me while he cant bec we were at the end of merge point no lines etc. while doing this he turned his tires towards me and his tires hit my left rear tire including the rims and dented the body above the tires.... He no say its my fault bec he said its his lane.... whos wrong?
